Yvonne B. Montgomery, Esquire, a partner at Tucker Law Group, LLC, headed a team that recently won  a precedential decision issued by The Third Circuit Court of Appeals which affirmed the district court’s grant of summary judgment in an employment discrimination lawsuit. The district court did not dismiss all of the claims and the remaining claims were tried to a jury by firm partner Joe H. Tucker, Jr.  TLG prevailed in the jury verdict and the plaintiff appealed only those claims that were dismissed at the summary judgment stage.  The appeals court agreed with TLG and the district court that the plaintiff had failed to put forth sufficient evidence of retaliation to withstand summary judgment. Daniels v. School District of Philadelphia, 2015 U.S.App. LEXIS 831 (3d Cir. 2015).
