Aguilar Bentley LLC is a boutique litigation firm, with attorneys licensed in New York and New Jersey, and substantial experience litigating cases throughout the country.  Each of our attorneys is a high-caliber senior-level attorney, hailing from large Manhattan law firms.  Because we keep our overhead low by minimizing junior-level staff, we are able to charge our clients below-market rates.  We aim to deliver a cost-effective solution to clients looking to maximize value and efficiency without compromising on quality.

Complex Commercial Litigation

We represent parties in state and federal courts across the country, as well as in arbitrations and other forms of alternative dispute resolution.  We aggressively protect our clients’ interests in all phases of a dispute.  For defendants involved in a civil litigation matter, the objective is to aggressively protect our clients’ rights in opposing the plaintiff’s claim.  On the other hand, plaintiffs in a civil litigation matter typically wish to right a wrong, enforce obligations in an agreement, or obtain compensation for an injury or other damages.

As experienced litigators, we develop strategies from the beginning of each representation to prepare the case for trial.  Nevertheless, we always take a practical approach and understand there may be times when exploring resolution before trial may be in the best interest of our clients.  We are always striving to develop creative solutions to complex disputes.  Our training and experience helps us to isolate the key issues in complex cases and to systematically attack each one.

Corporate Investigations

We are experienced in conducting and managing investigations, including representing companies in all types of internal investigations, compliance matters and enforcement proceedings.  We understand the sensitivity and complexity of such matters and approach them with discretion and thoroughness.  We are experienced in matters such as:

  • Conducting independent and thorough internal investigations and inquiries;
  • Working with clients to investigate potential violations of law and/or internal policies or procedures;
  • Informing management of violations that have occurred and determining an appropriate response to investigation findings;
  • Advising clients on self-reporting issues and securing favorable treatment as a result;
  • Creating and implementing a responsive compliance program and internal controls to prevent future violations.

Employment Law

We have a wide range of experience in handling employment-related litigation matters.  We have defended companies in connection with discrimination, workplace environment, and retaliation claims at all levels, including administrative (EEOC, Division of Human Rights, DOL), as well as state and federal court claims.  

In addition, we help companies wade through employee-related issues as they arise in the workplace in an effort to resolve concerns and avoid litigation.  We advise companies in connection with employment contracts, non-compete and non-solicitation agreements, confidentiality agreements, and issues relating to an employee’s separation from the company.  

We have experience in drafting and modifying employee handbooks and related policies and procedures, and we handle employment-related internal complaints and subsequent investigations.

Insurance Litigation

Our firm represents corporate policyholders in maximizing their insurance coverage recoveries.  We know that insurance is a valuable asset.  We seek creative and novel approaches to the effective litigation, negotiation and resolution of insurance cases so as to ensure that our clients’ recoveries for those losses and liabilities are maximized. 

We interpret insurance policies, draft and file lawsuits for recovery of insurance proceeds, respond to declaratory judgment lawsuits brought against our clients, locate expert witnesses, prepare oral and written discovery, negotiate settlements and bring cases to trial when necessary.  By making it a priority to partner with our clients to develop strategies that take into account the broader business, legal and public relations implications of the matters we handle, we have earned a reputation for hard work and outstanding results in all aspects of our practice.

Non-Party Subpoena Responses

We represent a variety of large and mid-size companies in responding to subpoenas seeking documents and testimony.  We liaise with issuing counsel, make efforts to reduce the scope of material being sought, negotiate date ranges and keyword searches, prepare the responses and objections, review and prepare documents for production, and prepare witnesses for depositions.  We quickly identify areas of concern for the client and identify confidential business and/or customer information.  We are cognizant of privilege issues, and determine a consistent approach regarding responsiveness.  We keep in-house counsel apprised of the status of the matter at all times.
