The CLE will provide an overview of ethical issues that arise with expert witnesses in litigation (skewing IP). We will briefly identify who is an “expert” and then address six topics:
- Ethical aspects of confidentiality issues involving experts
- Ethical considerations in the over-aggressive classification of expert materials as “draft reports”
- Litigators’ ethical duties in connection with reviewing an expert’s files
- Ethical limits on influencing expert testimony
- Ethical considerations of expert compensation
- ABA ethical opinion against communicating with opposing experts
