Successfully obtained with national counsel, the stipulated voluntary dismissal on personal jurisdiction grounds of a major trade association, from every case in the Johnson & Johnson Talcum Powder Litigation MDL but those designated for remand to the Districts of New Jersey and Columbia.  This dismissed hundreds of ovarian cancer claims and consortium claims.

Successfully obtained summary judgment in a Florida federal court for client, Rich Product Corp. in an action seeking overtime pay under the FLSA for a national class of truck drivers who deliver Carvel® ice cream cakes and other frozen desserts. The Court granted Schroder, Joseph & Associates’ motion for summary judgment at the close of discovery, finding the Defendant met its burden to demonstrate that the Motor Carrier Act exemption applied by reason of the undisputed facts.

Represented non-profit in negotiating ground lease for construction of Korean-American national museum, multi-family residential and shared museum-residential-public parking.  Client’s long-term goal is to purchase fee title.  We negotiated purchase option exercisable any time following 10th anniversary of project completion, based on raw land value without improvements or entitlements, but taking account of reduced value due to affordable housing covenant and public parking easement.  Ground lease authorizes residential component to be operated by non-profit’s newly formed for-profit subsidiary, an innovative approach under which subsidiary will serve as social responsibility enterprise by raising revenue to support non-profit.  John Lim and Marc Manason worked on this matter.
