In April 2015, Sotera L. Anderson, Senior Counsel at WTK, successfully brought a motion for summary adjudication in California state court for a products manufacturer in a case involving claims of false advertising in violation of California Business & Professions Code, violation of the Magnuson-Moss Warranty Act, and breach of the implied warranty of fitness.

 

In March 2015, Ms. Anderson successfully opposed a fee petition for a products manufacturer in a case involving claims of violation of the Consumer Legal Remedies Act, violation of Unfair Competition Law and breach of warranty.  Plaintiffs’ counsel sought several hundred thousand dollars in fees.  Ms. Anderson was able to convince the Court to reduce the fees to well below six figures – only 1/6th of the amount sought.  The client is thrilled. 

 

In January 2015, Ms. Anderson successfully brought a 12(b)(6) Motion to Dismiss in federal court for a products manufacturer in a case involving claims of violation of the Magnuson Moss Warranty Act.  The District Court granted her motion without leave to amend and dismissed the case against all defendants, even those who had litigated the case for a year and did not join in the motion.

Robert A. Shields, Partner at WTK, along with his wife, Cheryl Shields, were honored by the Mayor at a State of the City Address when they received the first ever Community Service Award for the City of Chula Vista.  The award is for their dedication and commitment in founding and hosting A Night To Remember Prom.  The Prom offers a free prom to children with special needs, complete with hosts, attire, flowers, hair/make-up, jewelry, photos, gifts bags, dinner, and, of course, music and dancing.
